Read the Terms and Conditions before registering and using the 1Backup service
With the registration of a 1Backup Account you, or the legal entity that represents you, accept to be bound to these Terms and Conditions that rule the access and the use of the 1Backup Service provided by CoreTech Srl and Neen Srl.
Note that the features of the service are variable in time and these terms refer to the actual features. It's possible that the previous versions of the service don't support all the features we're about to describe.
The user accepts to provide complete information when creating an account.
With the aim of preventing a non authorized access to the account, the user accepts to keep password and other information provided secret and not share with anybody.
As the only holder of your account, you are the only one responsible for the access to contents that relate to you or for the sharing and the use of your account. We are not responsible for any potential loss or damage caused by whichever access to your account, or by the share of your account. If you believe that a non authorized access to your account happened, contact us asap at the email address email@example.com.
Conditions of Use
By using our Services, the user accepts to:
- Be the only responsible for the gain of the needed rights for the content of files and data you stored on our servers;
- Not to use our Services to sell and/or distribute digital content to others. (Our services are not intended for the archiving and sharing of large amounts of data to a large number of receivers or for the diffusion of digital content with commercial scopes; we can use different procedures to identify non acceptable levels of use and proceed with the following de-activation of an account that improperly uses the service. We are not responsible for any potential business interruption that may follow.)
- Not access or try to access our Services by means of any other means different from the one provided by the 1Backup website or by a non authorized third part.
If there is a suspect that an account is used for stocking and sharing whatever illegal content, such as copyrighted material, we reserve the right to examine the content of the online storage and the backup account.
We can also access to the account and personal data for related support activities.
We usually don't review, check, modify or monitor content, data and files memorized by the user or by whichever other user of the Service.
We reserve the right to refuse, remove or disable the access to whatever file or piece of data memorized on our servers with an immediate effect whether we believe it is not readable, is violating the present Terms, is violating the rights of third parties or may be rationally questionable.
For an absolute privacy, we suggest to use the private cryptographic key that allows to use a code known only by the user, in addition to the basic account credentials..
Registration information / Privacy
The user has to inform immediately any change of the information provided during the registration (including any change in the postal address, phone numbers or email address).
Modalities of Payment
Once the order is complete, you can choose to pay with a Bonifico Bancario (Bank Transfer), Credit Card or Paypal. Payment with Credit Card is carried out with the Paypal website.
Should we not capable of executing every applicable cost because of a refusal of the credit car or whichever other reason, you will be notified via email. In case of a non intervention by the user, the order can be cancelled. We can delay the cancellation of the order due to a missed payment and give a tolerance period of up to sixty (60) days from the expiring date in order to allow the client to perform the payment.
In case a discrepancy in the invoice happens, the possible associated recovery is not due if such discrepancy is not notified within sixty (60) calendar days from the charge on the credit card.
Cancellations and refunds
In case of cancellation of the subscription plan before the natural expiring date, CoreTech Srl doesn't offer any pro-rata refund for the remaining period of time.
Business accounts can use an extra archiving space past the limit set by the plan adopted. This was planned in order to allow to perform backups without interruptions in case of an utilization that exceeds the quota limit. However, the part that exceeds the quota limit has an additional price of €12/GB/year. Even if not necessary, we encourage users to choose a plan with a bigger storage capacity if their use exceeds the limit set by the subscription plan choose in order to avoid additional expenses. Alternatively, we can perform a data synchronization to potentially bring the account below the quota limit. Data synchronization removes those files that are not memorized anymore in the computer of origin of such account.
You are the only responsible for any potential consequence derived by the lack of privacy of your password. Contact us immediately if you identity a non authorized access to your account To obtain an improved security, we advise to change your password frequently. The 'Recupera Password' (Retrieve Password) function implies that you are the only owner of the account that has access to the registered email address. In case the user doesn't have access to the email address, we can use other means of control and the invoicing/credit card to verify the identity.
We'll do our best to limit the access to data and documents related to your account to only the persons that are authorized to access your account. However, no archiving and data restore system protected by password can be made impenetrable. Therefore, we don't exclude the possibility that non authorized persons can access to your account, visualize, copy, modify and share memorized data and files.
1Backup adopts 256-bit AES cryptography before being transmitted from the computer by using:
- A predefined key;
- A private key that you create.
A proper cryptographic key must be chosen according to your privacy and security needs.
In order to transfer data based on web and mobile, data is sent to a ciphered channel with a 256-bit AES server-side cryptography.
If you choose the default cipher option, the system chooses a key for data cryptography. Even if data is still encrypted, the 1Backup staff may be capable of decrypting it should such situation could happen.
If you choose a private key to cipher your data, the 1Backup staff can't access to such key and it won't be stored on 1Backup servers. It's quite important to store the private key defined by the user in a safe place. All backup data can be restored only with such key and data may not be restored once the key is forgotten or lost. 1Backup is not responsible for the loss of data that can happen following such cases.
IP addresses usage
We can collect IP addresses with system administration purposes and/or monitor the use of our website. We can collect IP addresses to identify an user when we believe it's necessary to do so in order to guarantee the respect of our rules and terms, or to protect our service, the website, clients or others. Some services, such as user logs and registration emails, can also visualize IP addresses.
Redundant data backups
We perform regular redundant data backups to be protected against hardware or software errors should they happen.
The frequency of redundant backups may vary from one day to a couple of days.
In case of a restore of data from redundant backup devices to the main backup devices, available data may not be consistent with the producted data before the error happened.
At the moment we can store and restore thirty different versions of the backup files. These versions don't add up to the quota limit, if the amount of needed space to store 30 versions exceeds twice the space actually used, we reserve the right of limiting you number of stored versions for your account. We suggest to check periodically that backups are completed with success and, in case of errors, make some corrections.
1Backup requires a periodic check, at least once a week, to verify the execution of backups because backups may fail for a number of reasons including Internet connectivity problems, authentication problem, firewall, blocks by antivirus programs, modifications of the configuration of the computer, etc.. You should also update periodically the backup client to the most recent version. Release date are published on the download page of the product.
More computers and additional accounts
1Backup can backup an unlimited number of computers, tablet and/or mobile devices in a single account. When doing the backup on several computers, authentication data must be replicated on each computer on which you do the backup, including the private cryptographic key (if used).
Transmission, archiving, visualization and data and file restore through the World Wide Web is subject to a series of conditions that makes such transmission, archiving, visualization and restore potentially unreliable.
THEREFORE, YOUR ACCOUNT AND THE SERVICE ARE PROVIDED "AS THEY ARE" AND "AS AVAILABLE", AT YOUR OWN RISK.
CORETECH SRL, ON BEHALF OF ITS DISTRIBUTORS, ADVERTISERS AND SUPPLIERS, EXCLUDES ANY WARRANTY AND CONDITION, IMPLICIT OR EXPLICIT, DERIVED BY THE LAW OR OTHER, WITH RESPECT TO YOUR ACCOUNT AND SERVICE (INCLUDING, WITHOUT LIMITATIONS, SALEABILITY IMPLICIT WARRANTIES, SUITABILITY FOR A PARTICULAR SCOPE AND NON VIOLATION).
YOUR ACCOUNT AND THE SERVICE MAY NOT FULFIL YOUR NEEDS.
CORETECH DOESN'T PROVIDE ANY STATEMENT OR WARRANTY:
- That your account or THE SERVICE fill your needs;
- THAT ACCESS TO YOUR ACCOUNT OR TO THE SERVICE WILL BE PUNCTUAL, WITHOUT ERRORS, INTERRUPTIONS, VIRUSES OR SECURE;
- That data and files stored in your account won't GET LOST OR DAMAGED;
- That data on your desktop or server won't get lost or damaged;
- THAT FLAWS OF THE SERVICE WILL BE CORRECTED.
THE USER ACKNOWLEDGES that each data and material restored WITH THE USE OF THE SERVICE IS, ON ITS TURN, AT HIS/HER OWN RISK AND THAT HE/SHE WILL BE THE ONLY RESPONSIBLE FOR POTENTIAL DAMAGES TO THE COMPUTER OR LOSS OF DATA DERIVED TO THE RESTORE OF SUCH MATERIAL OR DATA.
Limitation of liability
IN NO CASE CORETECH OR ITS AFFILIATES, ADVERTISERS OR SUPPLIERS HAS ANY COMMITMENT OR RESPONSIBILITY ON COSTS FOR DATA PROVISIONING OR SUBSTITUTING SERVICES OR DIRECT, INDIRECT, INADVERTENT, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES (INCLUSING, WITHOUT LIMITATION, LOSS OF DATA, INCOME OR PROFIT OR INTERRUPTION OF ACTIVITY) OR ANY OTHER FINANCIAL LOSS DERIVED TO THE USE OR INABILITY OF USING YOUR ACCOUNT OR THE SERVICE OR the loss of data or files in which stored WITHOUT RESPECT TO LEGAL TERMS, REGARDLESS THAT CORETECH was informed or not OF THE POSSIBILITY OF SUCH DAMAGES.
We can, at our discretion and in addition to other remedies, immediately and without notification terminate the present Terms at any given time or suspend the access to the Services:
- In case of violation of whichever disposition of these Terms;
- If we are asked to do it by the law;
- If we cease to offer all the services covered by these terms;
- For any other reason, with thirty days of notification notified to you (or before, if the violation of these Terms represents a threat for other users or Services).
It's possible to withdraw the present Terms, prior written notification to send with at least thirty days of notification.
In case you don't accept any of these Terms or their following modifications or in case you are not satisfied of the services, the only solution is to immediately:
- Stop the use of services;
- Withdraw the present Tems;
- Notify us such closing as described at the following paragraph 13.
In case of withdrawal of the present Conditions, we will immediately remove data and files stored on the main memory and archives.
Any communication regarding the present Terms and Condition can be notified:
- Via email to the registration address;
- Via registered mail.
We advise you to check for the proper functioning of your own email account to be sure to receive our communications.
Every account cancellation request must be forwarded via email to the address firstname.lastname@example.org or via telephone to the number 02.55.23.08.93.
Following the cancellation of your account, all your personal data will be removed immediately. Cancellation can also be due to the lack of payment of an invoice.
In case of a payment delay, we can provide a tolerance period not greater to 60 days from the expiring date of the related invoicing to allow the client to proceed with the settle of the expired invoices.
The present Conditions will be applied with the greater measure allowed by the applicable law.
If any of the dispositions of the present Terms is considered not valid or not applicable with respect of the applicable law, then;
- Such disposition will be revised in the measure reasonably needed to make it valid, applicable and coherent with the original intent at the base of such disposition.
- Such invalidity or inapplicability won't have any effect on the other dispositions of the present Terms.
Modifications of the present Agreement
We reserve the possibility of modifying the present Conditions time by time and the most recent version will always be published on the web site at the address http://www.1backup.me.
If we think a modification of the present Terms can be substantial with respect to the fruition of our services, then we'll notify it to you personally (for instance, via email). Other variations will be stated in this page, therefore we invite you to check regularly the content. The continuing use of our Services, following such modifications, represent an implicit agreement of such terms and conditions and modifications. If you don't agree with the new conditions, we invite you not to use our Services anymore.
